Terms of Use

The short version
Bharometer is licensed to you for personal use on your own Apple devices. Your fuel data lives on your device and in your own iCloud — there is no Bharometer server, so back up your data and double-check the numbers before relying on them. Every figure the app shows is calculated only from the information you enter, so the results are only as accurate as your entries. Purchases are handled entirely by Apple. These Terms are governed by the laws of India.
1. Introduction
Bharometer ("the app") is an iOS application that helps you track your fuel fill-ups, vehicle expenses and mileage directly on your device. It is developed, published and operated by DigiTally / Positiva Films, Mumbai, India ("we", "us", "our"). You can reach us any time at tally@positivafilms.com.
These Terms of Use form an end-user licence agreement ("EULA") between you and us. They set out the conditions under which you may use the app. Apple Inc. ("Apple") is not a party to this EULA, but — as explained in section 13 — Apple has certain rights under it.
You may only download the app from the Apple App Store. Where the app offers paid upgrades, their prices are always shown to you in advance inside the app and on the App Store.
2. Acceptance of these Terms
By installing, accessing or using Bharometer, you accept these Terms. If you do not agree to them, you must not use the app — and if you have already installed it, you must uninstall it from your device.
You may not use the app or accept these Terms if (i) you are not of the legal age required to enter into a binding agreement, or (ii) you are barred from using the app under applicable law. If you use the app on behalf of your employer, you confirm that you are authorised to accept these Terms on your employer's behalf.
3. Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to use Bharometer for your personal, non-commercial purposes on Apple-branded devices that you own or control, in accordance with the Apple App Store Terms of Service and these Terms.
Personal use only. Commercial use is not permitted under this licence. This includes (without limitation):
- using the app to manage commercial fleets or to provide services to third parties;
- reselling, renting, transferring or distributing the app or access to it in any form;
- using the app in conjunction with any commercial vehicle-tracking or fleet-management system.
We reserve the right to terminate this licence and pursue any other remedies available at law if the app is used commercially in breach of these Terms.
Prohibited actions. You may not copy, distribute, modify, adapt, reverse-engineer, decompile or disassemble the app, attempt to obtain its source code, or create derivative works based on it, except to the extent expressly permitted by applicable law.
4. In-app purchases & subscriptions (Bharometer Pro)
Bharometer offers an optional paid upgrade, Bharometer Pro, available as a monthly subscription, a yearly subscription or a one-time lifetime purchase.
- Payment processing. All payments are processed by the Apple App Store. We do not collect or store your payment information, and your purchase is granted when Apple confirms a successful transaction.
- Pricing. Prices are displayed in the app and on the App Store before you buy. We may change the pricing and availability of in-app items at any time; changes do not affect a period you have already paid for.
- Automatic renewal. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. Your Apple account is charged for renewal within 24 hours before the current period ends.
- Cancellation. You can manage or cancel your subscription at any time in your Apple ID settings (Settings → your name → Subscriptions). Cancellation takes effect at the end of the current billing period.
- Refunds. Refund requests are handled by Apple in accordance with App Store policies — visit reportaproblem.apple.com. We cannot issue refunds directly.
- Licensed, not sold. Pro features are licensed to you, not sold, and have no monetary value outside the app.
- Disputes. For billing or payment disputes, contact Apple Support. If a Pro feature is not working as it should, contact us at tally@positivafilms.com and we will help.
5. Your responsibilities
Device & connectivity. Some features (for example the pumps map, directions, weather snapshots and iCloud sync) need an internet or data connection. The configuration of your device, and any data charges from your mobile operator, are your responsibility.
Data you enter. Bharometer's calculations rely entirely on the data you provide — fill-ups, odometer readings, prices, distances and costs. You are solely responsible for the accuracy and completeness of the data you enter. We do not independently measure, verify or source any of this data, and we are not responsible for any issue arising from incorrect, incomplete or mistaken input.
Output. The app's statistics, mileage figures, cost estimates, averages, trends and reports are generated solely from your input using standard calculations — a correct entry produces a correct result, and an incorrect or incomplete entry will produce an incorrect result. While we strive to keep the calculations themselves reliable, you alone are responsible for the accuracy of your entries and for reviewing and verifying every figure before relying on it for any decision (for example servicing, budgeting, reimbursement, tax or resale decisions). To the maximum extent permitted by law, we accept no responsibility or liability for any decision, loss, cost or claim arising from figures that were produced from inaccurate, incomplete or mistaken input.
Safe use. Do not operate the app while driving or riding. Enter data and view the map only when your vehicle is safely stopped. You must comply with all applicable laws, including the Motor Vehicles Act and road-safety rules, while using the app.
Lawful use. You agree not to use the app in any unlawful manner, interfere with or disrupt its operation, or attempt to gain unauthorised access to it.
Backups. Bharometer stores your information locally on your device, and — only if you enable it — in your personal iCloud account. We do not operate a backend server and keep no copy of your data, so we cannot recover data that was not backed up. You are responsible for confirming that iCloud is signed in, has enough storage and has finished syncing before erasing or replacing your device. We are not responsible for data loss caused by uninstallation, device failure, misconfigured backups or issues with Apple's iCloud service. You can also export your data to CSV from Settings as an additional backup.
6. Fuel prices, pumps & station information
Fuel prices shown in the app are the prices you entered when logging fill-ups — they are historical, personal records, not live market rates. Always verify the actual price at the pump before purchasing. We are not responsible for decisions made based on prices, averages or estimates shown in the app.
Pump locations, names and details on the map come from Apple Maps and may be incomplete, out of date or inaccurate. Fuel-company names and logos are displayed for identification purposes only; we do not claim ownership of these marks, and their display does not imply any endorsement by, or affiliation with, the respective brands.
7. Indemnity
You agree to indemnify, defend and hold us — and our owners, partners and collaborators — harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your use of the app, your violation of these Terms, or your violation of any rights of another person.
8. Disclaimer of warranties
The app is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. In particular:
- No bug-free guarantee. We work hard to make Bharometer reliable, but we do not warrant that it will be error-free or uninterrupted.
- No performance guarantee. We do not guarantee that the app will meet your specific requirements — its output depends heavily on the data you enter.
- Data storage. The app stores data on your device (and optionally in your iCloud). We are not responsible for loss or corruption of data on your device — see section 5 on backups.
- Beyond our control. We bear no responsibility for non-performance caused by factors outside our reasonable control, such as poor GPS signal, lack of internet connectivity, or outages of Apple services.
- Older versions. As the app improves, we may stop supporting older versions. If that happens we will make a newer version available; if you choose not to update, we are not responsible for defects or incompatibilities in the outdated version.
9. Limitation of liability
To the fullest extent permitted by applicable law, in no event shall we be liable for any indirect, incidental, special, consequential or punitive damages — including loss of profits, data, goodwill or other intangible losses — resulting from (i) your access to, use of, or inability to use the app; (ii) any content obtained from the app; or (iii) unauthorised access to or alteration of your data, whether based on warranty, contract, tort (including negligence) or any other legal theory, even if we have been advised of the possibility of such damage. Nothing in these Terms limits any liability that cannot be excluded under applicable law, or affects your statutory rights as a consumer under the Consumer Protection Act, 2019 and other applicable Indian law.
10. Support & complaints
We provide technical support by email at tally@positivafilms.com (or via the Support page). Please describe the problem in enough detail — device model, iOS version and steps to reproduce — so we can help you effectively.
If you believe the app has a defect, or you are unhappy with the support you received, write to the same address with "Complaint" in the subject line. We will acknowledge your complaint without undue delay and aim to resolve it within 30 days. Your statutory consumer rights under Indian law remain unaffected.
We are not obliged to provide support where the reported problem results from unauthorised interference with the app, incorrect device settings, or use of the app in breach of these Terms. Technical information you share as part of a support request may be used internally to improve the app.
11. Intellectual property
The app and its original content (excluding data provided by you), features and functionality are and will remain our exclusive property. The app is protected by copyright and other laws of India and other countries. Our name, branding and designs may not be used in connection with any product or service without our prior written consent.
12. Third-party services
The app uses Apple services (App Store purchases, iCloud, Apple Maps, WeatherKit) and PostHog for anonymous product analytics. Your use of these services is subject to their respective terms and privacy policies. Bharometer does not collect or use your device's advertising identifier for any purpose — the app shows no ads. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
13. Apple-specific terms
These additional terms apply because the app is distributed through the Apple App Store:
- This EULA is between you and us only, not with Apple. We — not Apple — are solely responsible for the app and its content.
- Apple has no obligation to provide any maintenance or support for the app.
- In the event the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims relating to the app, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer-protection claims.
- Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.
14. Personal data
How the app handles your data is described in our Privacy Policy. In short: your data stays on your device and in your own iCloud; we have no account system and no backend.
15. Changes to these Terms
We may update these Terms from time to time, for example alongside app updates. We will post the revised Terms on this page with a new "last updated" date. By continuing to use the app after changes take effect, you accept the revised Terms; if you disagree with a change, you must stop using the app and uninstall it.
16. Termination
We may terminate or suspend your licence immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the app ceases. Sections that by their nature should survive termination (including sections 7–9, 11 and 17) will survive.
17. Governing law
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law provisions. Any disputes are subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra. Mandatory consumer-protection law that applies to you remains unaffected.
Our failure to enforce any right or provision of these Terms is not a waiver of it. If any provision is held invalid or unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement between you and us regarding the app and supersede any prior agreements regarding it.
